General Terms & Conditions of Sale
General
These General Terms and Conditions of Sale are considered accepted in full by the customer and cannot be modified by contrary clauses appearing on any medium by order of our customers, unless there is a written agreement before any order acceptance.
Order
The order will only include the material specified in the acknowledgment of receipt or delivery invoice confirming the order. Any modification or additional supply will be invoiced separately. Any modification or cancellation of the order by the customer will be considered only if it reaches AKROVALIS S.L. in writing before its preparation begins and subject to prior written acceptance by AKROVALIS SL. Subsequent modifications may entail additional expenses, which will be indicated to the customer for acceptance, and may, if necessary, cause a delay in the delivery of the order in question. Any order shall not become final until our acceptance.
Price
The price is the amount established by our offers or rates in force, indicated on the website on the day and time of purchase, except for errors or omissions, which, if any, will be immediately communicated to the customer so that they can exercise their right of withdrawal if they wish. The mention of our prices on the website is established with taxes included for the national market (the areas of Canary Islands, Ceuta, and Melilla, at the time of indicating the shipping address, will be exempt from VAT according to Article 21 of Law 37/1992, of December 28, on Value Added Tax). The prices and information in catalogs, brochures, and rates are indicative and subject to review and modification, in which case you will be promptly notified, and the valid price will be the one indicated on the invoice at the time of shipment.
Delivery
Delivery times are provided solely as an indication, commencing from the latest of the following dates: acknowledgment of receipt of the order, receipt of additional information, and advance payment. Product delivery shall be deemed to have been made at the time of direct delivery to the customer, through notification of availability or through delivery of the ordered material to a shipper or carrier. Products, even if shipped free of transport costs, travel at the recipient’s risk and expense, who shall exercise the appropriate actions against the carrier if necessary.
Payment
All orders can be paid by Bank Transfer, Debit/Credit Card, PayPal, or Scalapay. Payment methods are available on the last step to confirm the order. Please note that any pending payment orders will not proceed with shipping.
Purchase Confirmation – If you purchase with Scalapay, you will receive your order and pay in 3 installments. You confirm that the installments will be sold to and bought by Retail Instalments SPV 1 Limited, to the related parties and their beneficiaries, and hereby unconditionally and irrevocably authorize and consent to this purchase.
Transport Conditions
Iberian Peninsula
Shipping cost will be €5 and the delivery time is 24 to 48 business hours.
For shipments to Andorra, the amount is €30, and the delivery time is between 3 and 4 business days.
For shipments to Gibraltar, the amount is €30, and the delivery time is between 3 and 4 business days.
Balearic Islands
Shipping cost will be €5 and the delivery time is 3 to 4 business days.
Canary Islands, Ceuta and Melilla
The cost of the transport service is €29.04 and the estimated delivery time is 3 to 4 business days. The delivery time both in the Islands and in Ceuta and Melilla are subject to customs procedures, and the recipient is responsible for import taxes and duties.
Europe
The delivery time is 1 to 5 business days. Shipments have a cost based on the shipping zone detailed below:
ZONE 1, 2, and 3 (Western Europe): The shipping cost to these zones is €15 per order, and the countries covered by these zones are Germany, Austria, Belgium, Denmark, Slovakia, Slovenia, France, Liechtenstein, Luxembourg, Monaco, Netherlands, Poland, Czech Republic, and Switzerland.
ZONES 4 and 5 (Eastern and Northern Europe): The cost for these shipping zones will be €15 per order, and the countries covered by these zones are Albania, Bosnia & Herzegovina, Belarus, Bulgaria, Cyprus, Croatia, Estonia, Finland, Greece, Hungary, Ireland, Iceland, Faroe Islands, Kosovo, Latvia, Lithuania, Macedonia, Malta, Montenegro, Norway, Romania, Russia, Serbia, Sweden, Turkey, and Ukraine.
Rest of the world
The delivery time is 3 to 8 business days for shipments to America, Africa, Asia, and Oceania.
The shipping cost will be displayed before completing a purchase, depending on the shipping address of each order.
Exchanges and Returns
In accordance with current regulations, the customer may exchange or return the goods without explanation within a maximum period of 14 days, provided that the goods have all their elements and are in their original packaging. The exchange or return will be rejected if the product has been used or tampered with, there is damage, misuse, or any damage from external causes. In any case, the transportation costs for exchanges or returns shall be borne by the customer. The amount of the purchase will be refunded by the same means as the payment, after verifying the condition of the goods.
- In the case of purchasing a container, no returns or exchanges will be accepted for health reasons.
After-Sales Service
AKROVALIS SL will guarantee after-sales service. Defective merchandise must be returned, along with the required proof of purchase, and upon receipt of AKROVALIS S.L.’s confirmation, which may issue an authorization number. The return must be made at the customer’s expense. Repair costs for material not covered by the warranty must be paid in advance.
Applicable Law and Jurisdiction
For matters not expressly provided for in this contract, the parties shall be governed by the provisions of the Commercial Code, special laws, commercial practices, and, failing that, by the provisions of the Civil Code. Any dispute, difference, or claim arising from this Contract, including in particular, its information, validity, enforceability, interpretation, performance, breach, or termination, as well as any non-contractual claims that may arise, shall be subject to the jurisdiction of the Courts and Tribunals of Barcelona.
